Pursuant to the Law on Organization of the Government on June 19^th, 2015;

Pursuant to the Decree No. 123/2016/ND-CP on September 1^st, 2016 of the Government assign the function, mission, power and the structure of the system of the Ministries, ministerial-level agencies;

Pursuant to the Decree No. 05/2011/ND-CP on January 14^th, 2011 of the Government about the Ethnic Minorities Work;

At the proposal of the Ministry, Chairman of the Committee for Ethnic Minority Affairs;

The Government enact the Decree on the function, mission, power and the structure of the system of the Committee for Ethnic Minority Affairs.

Article 1. Position and functions

The Committee for Ethnic Minority Affairs is a ministerial-level agencies of the Government, have function as state management about the ethnic minorities work at national scale; the public services under the management of The Committee for Ethnic Minority Affairs according to the Law.

Article 2. Tasks and powers

The Committee for Ethnic Minority Affairs execute stipulating tasks, powers on the Decree No. 123/2016/ND-CP on September 1^st, 2016 of the Government stipulating the functions, tasks, powers and organizational structure of ministries, ministerial-level agencies and specific tasks, powers as below:

1. Submit to the Government the bills, draft resolutions of the National Assembly; draft ordinance, decision of National Assembly Standing Committee; draft decree of the Government following the program, annual plan building the Law of the Government and resolutions, projects, schemes following the assignment of the Government, the Prime Minister.
2. Submit to the Government the strategies, planning, long-term, five-year, annually plans and projects, important national engineerings on the field managing by the Committee for Ethnic Minority Affairs.
3. Submit to the Government, the Prime Minister enact Ethnic policies, specific policies, programs, projects, schemes developing socio-economy, supporting hamlets, communes have difficult and specially difficult socio-economic conditions in the ethnic minorities and mountainous areas, communes near the borders, communes in the safe areas, remote and mountainous areas; invest and support policies to help literally minority people settle down; policies, projects supporting people in the specially difficult areas; development and conservation policies, projects for small literally minority people and execute policies, programs, projects, schemes after the promulgation.    
4. Submit to the Government, the Prime Minister enact policies for the influential individuals among literally minority people, specific policies to the cadres, officials in the system of agencies do the ethnic minorities work, associating with Ministry of Home Affairs build, process have the authority enact policies attracting and increasing the number of cadres, officials to work in the ethnic minorities and mountainous areas.
5. Submit to the Prime Minister the draft decision, directive and other documents about the ethnic minority affairs following the assignment.
6. Preside or coordinate with other Ministries, agencies have the authority enacts policies to develop the human resource at the ethnic minorities and mountainous areas; policies training, using the cadres from the minority group, upgrading the people’s intellectual standard in the ethnic minorities and mountainous areas; policies for the literally minority people to use the rights to use their native languages, maintain their cultures and develop their good customs, habits, traditions and cultures; policies developing and supporting educating infrastructures to meet the demands to educate people in the ethnic minorities and mountainous areas.
7. Process have the authority to enact or enact following the authority’s criteria to determine the minority groups, list the Vietnamese ethnic groups; criteria to allocate ethnic minorities and mountainous areas by the development level, list the communes in the ethnic minorities and mountainous areas in difficulties, special difficulties.
8. Enact the Circular, Decision, Directive under the state management of the Committee for Ethnic Minority Affairs; check all the legal documents by the Ministers, People’s Committees of the provinces and cities directly under the Government involved in the ethnic minority work; being asked to participant to check the important draft legal document directly involved the execution of ethnic policy prepared by the Ministries, ministerial-level agencies, government-attached agencies directly involved in the ethnic minority work.
9. Direct, guide, check and to be responsible for executing the legal documents, strategies, planning, plans, programs, projects, schemes, important national engineering, Decision, Directive were enacted or approved under the state management of the Committee for Ethnic Minority Affairs.
10. Preside or coordinate with other Ministries, ministerial-level agencies, government-attached agencies and political – social organizations preliminary, summary, evaluate for the execution of the policies of the Party, law of the Government involved in the ethnic minority work, annual and urgent report to the Government and the Prime Minister according to the law; check the execution of the ethnic policies by the Ministries, ministerial-level agencies, Governmental agencies and locals; petition the authority agencies enact, modify, amend, to complete the ethnic policies suitable with the reality and request, tasks of the ethnic minority work of the Party, Government.
11. Direct, guide to build forward-looking groups, individuals, influential citizens in the ethnic minorities areas; award according to the authority or the authority proposal groups and individuals have excellent achievement in work, production, building, socio-economic development, maintaining the security, order and setting good example of executing of the policies of the Party, law of the Government in the ethnic minorities areas.
12. Direct, guide to execute and check the arrangement of National Minority People’s Congress at the province and district levels; arrange the cultural and experiences exchanges among representatives of the ethnic minority groups, influential individual in the literally minority people and other events involved to ethnic minority work to unite all the ethnic groups.
13. Propagate, motivate the literally minority people to execute the policies of the Party, law of the Government, develop the good customs, habits, traditions of the ethnic groups; propagate, spread, educate Law under the state management of the Committee for Ethnic Minority Affairs; coordinate with the ministries, agencies involved in engineering and arranging the execution of the schemes, projects to increase the media tasks, put the information about the ethnic minorities and mountainous areas, broadcast through radio and ethnic television on Internet; coordinate with the policy legal support for the literally minority people.  
14. Arrange, direct the basic and urgent scientific researches, strategy’s issue about the ethnic minority groups and ethnic policies; making theoretical research and practical conclusion about the ethnic minority work; adapting, handing over science, technology and environmental protection for ethnic minorities and mountainous areas; activities involved adapt information technology in the ethnic minority work by the agency system do the ethnic minority work and ethnic minorities and mountainous areas.             
15. Watch, check and collect the data about the current situation of the ethnic minority areas, execution of the ethnic minority work by the Ministries, ministerial-level agencies, government-attached agencies and locals, propose, petition the authority agencies to consider and solve the problems involved the ethnic minority work and literally minority people.
16. Build the criteria system under the state management about the ethnic minority work, database system of the ethnic minority work, data about the literally minority people.
17. Investigate, check, conduct research, and collect the data of the socio-economic development of ethnic groups, ethnic people, name, customs, habits of the ethnic minority groups and other ethnic issues.
18. Coordinate with the Ministries, agencies involved the establishment of plans, submit to the Government to distribute the resource to decline the poor level and other resources for the ethnic minority locals, examine or participate the examination of the programs, projects, schemes, plan developing the socio-economy of the ethnic minority areas according to the Law.
19. International coordinate in the fields under the state management of the Committee for Ethnic Minority Affairs according to the Law; coordinate with oversea organizations, individuals, international organizations on research, exchange experience on ethnic minority work, attract the funds investing and developing the ethnic minority areas, areas have the socio-economic condition in difficulties, special difficulties according to the Law; manage, direct or participate programs, projects by the oversea, international organization sponsor, invest to the ethnic minority areas according to the Law.
20. Decide and arrange the execution of the plan of reforming the administration, publicize administration procedures belong to the ethnic minority work; execute other tasks about the administrative reformation according to the Law.
21. Inspector checks the execution of the policy, law in the ethnic minority work; solve the complaint, accusation and petition of citizen; prevent the corruption, negativity and handle the wrongdoing in fields under the state management of the Committee for Ethnic Minority Affairs according to the Law.
22. Welcome, greeting and coordinate with the Ministries, local to fulfill the literally minority people’s wish following the regulation, policy and the Law.       
23. Governmental manage public services belongs to the ethnic minority work; execute public services in the field under the state management of Committee for Ethnic Minority Affairs according to the Law.
24. Manage the machinery, officials, workers; position, officials’ mechanism following by occupations and the number of employees in the independence unit, decide to appoint, reappoint, deploy, circulate, resign, dismiss, second, reward, discipline, be resigned, retired, execute the salary and other regulations, encouragement policy to the cadres, officials by the Committee for Ethnic Minority Affairs according to the Law of the Party and Government; enact the criteria for agencies’ leader, manager do the ethnic minority work of the People’s Committee, city direct under the Government; coordinate with agencies involved in giving instruction to planning, train, use, manage the cadres from the literally minority people in the politic system.      
25. Calculate the budget annually; coordinate with the Ministry of Finance to create, collect the calculation of the budget following by the agency, field under the management to submit to the Government; execute other tasks about the government budget, finance, property according to the Law,   
26. Execute tasks, powers by the Government, Prime Minister assign and not against the Law.

In this article, units from the paragraph 1 to paragraph 13 are help the Minister, Chairman of the Committee for Ethnic Minority Affairs execute the state management; units from paragraph 14 to paragraph 18 are serve the governmental management function of the Committee for Ethnic Minority Affairs.

Units: The Planning-Finance Department, The Department of Ethnic Policies, The Department of Locality II, III have 02 offices; The Department of Organization and Personnel has 01 office; The Office of the Committee for Ethnic Minority Affairs has 05 offices and the Representative Office in Ho Chi Minh City; the Inspectorate of the Committee for Ethnic Minority Affairs has 04 offices.

Article 4. Implementation effect

1. This Decree will take the effect on March 26^th, 2017
2. This Decree will replace the Decree No. 84/2012/ND-CP on October 12^th, 2012 of the Government stipulating the functions, tasks, powers and organizational structure of the Committee for Ethnic Minority Affairs.

Article 5. Implementation responsibilities

Ministers, heads of ministerial-level agencies, heads of government-attached agencies, chairmen of People's Committees in province, city direct under the Government shall implement this Decree.
